Privacy Policy

This Privacy Policy explains how FieldworkABA collects, uses, stores, shares, and protects information when you access or use our website at https://fieldworkaba.com, our web application, mobile application, fieldwork tracking tools, exam preparation tools, supervisor tools, organization tools, dashboards, reports, support services, and related services — collectively, the “Service.”

The Service is operated by FieldworkABA (“FieldworkABA,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to the collection, use, disclosure, and handling of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, do not use the Service. This Privacy Policy should be read together with our Terms of Service.

1. Important Notice About BACB and Healthcare Information

FieldworkABA is an independent fieldwork tracking, supervision support, documentation, and exam preparation platform. We are not affiliated with, endorsed by, certified by, licensed by, sponsored by, reviewed by, or acting on behalf of the Behavior Analyst Certification Board, Inc. (“BACB”).

FieldworkABA is not intended to store patient records, medical records, clinical records, Protected Health Information (“PHI”), or detailed client-identifying information. Unless we enter into a separate written agreement that expressly states otherwise, FieldworkABA is not provided as a HIPAA-covered system and we do not act as a HIPAA Business Associate.

Do not enter client full names, medical record numbers, insurance information, dates of birth, addresses, phone numbers, diagnosis details tied to an identifiable person, or other information that could identify a client or patient.

You are responsible for complying with HIPAA, FERPA, employer policies, university policies, clinic policies, supervision requirements, professional ethics requirements, and any other privacy rules that apply to your work.

2. Information We Collect

We collect information you provide directly, information generated through your use of the Service, information collected automatically, and information received from connected users or service providers.

2.1 Account Information

When you create or manage an account, we may collect:

  • Name;
  • Email address;
  • Password or authentication information;
  • Account role, such as trainee, supervisor, or organization administrator;
  • Certification-related profile information;
  • Supervisor or trainee invitation details;
  • Organization name and team information;
  • Billing status and subscription plan;
  • Account settings and preferences;
  • Support history and communication preferences.

We use real email addresses for account access, supervisor invitations, notifications, account recovery, and record-related communication.

2.2 Fieldwork Tracking Information

When you use fieldwork tracking features, we may collect and store information such as:

  • Fieldwork dates;
  • Logged hours;
  • Restricted and unrestricted activity categories;
  • Supervised and independent fieldwork designations;
  • Monthly totals;
  • Experience type;
  • Supervisor names and contact details;
  • Supervisor-trainee connection status;
  • Observation records;
  • Supervision contact records;
  • Monthly verification records;
  • Final verification records;
  • Uploaded files or imported records;
  • Notes, descriptions, and comments you choose to enter;
  • Reports, summaries, and exports generated through the Service;
  • Audit logs and record history.

You are responsible for ensuring that fieldwork data entered into the Service is accurate and does not include PHI or unnecessary client-identifying information.

2.3 Supervisor and Organization Information

If you use supervisor or organization features, we may collect:

  • Supervisor profile details;
  • Trainee profile details;
  • Invitation history;
  • Connection approvals, removals, and status changes;
  • Organization membership;
  • Administrator permissions;
  • Team settings;
  • Supervisor review activity;
  • Access logs;
  • Audit logs;
  • Organization billing information;
  • Aggregate organization-level usage and fieldwork summaries.

Connected supervisors and organization administrators may be able to view certain trainee information depending on the permissions, plan, and account structure.

2.4 Exam Preparation Information

If you use exam preparation features, we may collect information such as:

  • Practice questions viewed;
  • Answer choices selected;
  • Correct and incorrect responses;
  • Question attempts;
  • Quiz mode or study mode activity;
  • Scores and progress indicators;
  • Study history;
  • Time spent in study tools;
  • Topics, concepts, or task list areas practiced;
  • Explanations, rationales, traps, hints, and support visuals shown to you;
  • Performance patterns and learning analytics;
  • Bookmarks, notes, flags, or saved questions;
  • Adaptive study recommendations.

We use this information to provide exam preparation features, personalize study support, improve explanations, show progress, and help you continue practice across sessions. Exam preparation data is not official BACB exam data and does not represent your actual exam performance.

2.5 Payment and Subscription Information

If you purchase a subscription, sponsor another user, or use a paid plan, payment information may be collected and processed by a third-party payment processor. We may collect and store:

  • Subscription plan;
  • Billing status;
  • Payment history;
  • Invoice information;
  • Last four digits of a payment card, if provided by the payment processor;
  • Billing email;
  • Cancellation status;
  • Trial status;
  • Sponsorship status.

We do not store full credit card numbers on our own servers.

2.6 Support and Communication Information

When you contact us, we may collect your name and email address, support messages, screenshots or files you choose to send, bug reports, feature requests, feedback, communication history, and information needed to troubleshoot your account. If you ask us to help import, move, or review fieldwork records, we may process the files or information you provide for that support request.

2.7 Device, Log, and Usage Information

When you access the Service, we may automatically collect IP address, browser type, device type, operating system, app version, referring URL, pages viewed, features used, dates and times of access, session information, error logs, crash logs, performance data, security logs, authentication events, approximate location based on IP address, and cookie and similar technology data. We use this information to operate the Service, protect accounts, troubleshoot issues, improve performance, prevent abuse, and understand how users interact with the Service.

2.8 Cookies and Similar Technologies

We may use cookies, pixels, local storage, session storage, and similar technologies to keep you signed in, remember preferences, secure your account, measure website and app performance, understand usage patterns, improve features, test changes, provide support tools, and manage marketing or analytics where permitted. You can control cookies through your browser settings. If you disable cookies, some parts of the Service may not function properly.

2.9 Information From Third Parties

We may receive information from third parties such as payment processors, authentication providers, email delivery providers, analytics providers, support tools, supervisors who invite trainees, trainees who invite supervisors, organizations that create or manage team accounts, and service providers that help us operate the Service. We only use this information as described in this Privacy Policy and as needed to provide, secure, support, and improve the Service.

3. How We Use Information

We use information to provide, maintain, secure, improve, and support FieldworkABA. This includes using information to:

  • Create and manage accounts;
  • Authenticate users;
  • Provide fieldwork tracking features;
  • Provide exam preparation features;
  • Generate dashboards, summaries, reports, and exports;
  • Track progress across fieldwork and study activities;
  • Enable supervisor-trainee connections;
  • Enable organization-level administration;
  • Process subscriptions, sponsorships, payments, and invoices;
  • Send account notices, reminders, and service-related messages;
  • Send supervisor invitations and trainee invitations;
  • Provide customer support;
  • Help move or import records from other tracking systems;
  • Troubleshoot bugs and performance issues;
  • Detect, prevent, and investigate fraud, abuse, security incidents, or unauthorized access;
  • Improve the Service and develop new features;
  • Analyze usage trends;
  • Personalize user experience;
  • Comply with legal obligations;
  • Enforce our Terms of Service;
  • Protect the rights, safety, and property of FieldworkABA, our users, and others.

We may also use de-identified or aggregated information for analytics, product improvement, research, reporting, business planning, and industry insights.

4. Automated, Adaptive, and AI-Assisted Features

FieldworkABA may use automated, adaptive, or AI-assisted features to support fieldwork tracking, imported record review, study tools, explanations, question practice, visual supports, reminders, summaries, or other Service functions. These features may process information you provide or generate through the Service, such as fieldwork entries, uploaded records, notes, question responses, study activity, or support requests.

We may use third-party service providers to help provide automated, adaptive, or AI-assisted features. You should not enter PHI or client-identifying information into any feature of the Service. Unless expressly disclosed otherwise, we do not intentionally use your identifiable fieldwork records, supervisor records, or exam preparation responses to train public third-party AI models. Automated or AI-assisted output may contain errors. You are responsible for reviewing any output before relying on it.

5. How We Share Information

We do not sell your fieldwork records, supervisor records, or exam preparation activity. We may share information in the following circumstances.

5.1 With Connected Supervisors

If you connect with a supervisor through the Service, that supervisor may be able to view certain information from your account, such as fieldwork records, progress summaries, reports, monthly records, supervision information, and related documentation. You should only connect with supervisors you authorize to view your fieldwork information.

5.2 With Connected Trainees

If you are a supervisor, trainees you connect with may be able to view certain information from your supervisor profile, such as your name, email address, connection status, and information needed to manage the supervisor-trainee relationship.

5.3 With Organizations

If your account is connected to an organization, organization administrators may be able to view or manage certain information based on the organization’s plan and permissions. This may include account information, fieldwork summaries, supervision activity, team membership, reports, audit logs, billing information, and administrative settings. Organizations are responsible for using this information in compliance with applicable laws, employment rules, student policies, supervision agreements, and internal policies.

5.4 With Service Providers

We may share information with third-party service providers that help us operate the Service. These providers may support hosting and storage, database infrastructure, authentication, payment processing, email delivery, customer support, analytics, security monitoring, logging and error tracking, file storage, document generation, AI-assisted or adaptive features, marketing and communication tools, billing and subscription management, and product performance monitoring. Service providers are authorized to use information only as needed to provide services to us or as otherwise permitted by law.

5.5 For Legal, Safety, and Security Reasons

We may disclose information if we believe it is reasonably necessary to comply with a law, regulation, subpoena, court order, or government request; enforce our Terms of Service; protect our rights, property, or safety; protect users, supervisors, organizations, or the public; detect or prevent fraud, abuse, or security incidents; investigate unauthorized access or misuse; or respond to legal claims.

5.6 Business Transfers

If FieldworkABA is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction, information may be transferred as part of that transaction. We will make reasonable efforts to ensure that any successor handles personal information in a manner consistent with this Privacy Policy.

5.7 Aggregated or De-Identified Information

We may share aggregated, anonymized, or de-identified information that does not identify you personally. For example, we may use aggregated information to understand product usage, improve features, generate internal reports, or describe general usage trends.

6. We Do Not Sell Personal Information

We do not sell your fieldwork records, exam preparation activity, supervisor records, or account records. Some privacy laws define “sale” or “sharing” broadly and may treat certain advertising, analytics, or cookie-based activities as a sale or sharing of personal information. If our use of cookies or similar tools is considered a sale or sharing under applicable law, you may have the right to opt out as described in this Privacy Policy or through any privacy controls we provide.

7. Communications

We may send you service-related communications, including account verification emails, password reset emails, supervisor or trainee invitations, fieldwork reminders, monthly record reminders, subscription notices, payment notices, security alerts, policy update notices, support responses, and important account or Service announcements. These service-related communications are necessary for the Service and cannot always be disabled while your account remains active.

We may also send optional marketing or product update communications where permitted by law. You may opt out of marketing emails by using the unsubscribe link or contacting us. If we offer SMS or text message notifications, you may opt out by replying STOP or following the instructions in the message. Message and data rates may apply.

8. Cookies and Tracking Choices

You can usually set your browser to remove or reject cookies. Browser settings vary, so review your browser’s help settings for instructions. If you disable cookies, some features may not work properly. Depending on your location, you may also have access to cookie banners, privacy settings, or opt-out tools that allow you to manage certain analytics, advertising, or tracking preferences. We may use essential cookies needed for login, security, account access, and basic functionality; preference cookies that remember settings; analytics cookies that help us understand how users interact with the Service; performance cookies that help us identify errors; and marketing cookies that may help us measure campaigns where permitted.

9. Data Retention

We retain information for as long as reasonably necessary to provide the Service, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud or abuse, maintain security, and support business operations. Fieldwork records, forms, reports, and related documentation may be retained for as long as your account remains active and, where applicable, for any storage period described in your plan, account settings, or product materials. You are responsible for exporting and keeping your own copies of records you consider important.

We may retain some information after account deletion where necessary for legal compliance, tax and accounting records, fraud prevention, security investigations, dispute resolution, backup and archival systems, enforcement of our Terms, and legitimate business needs permitted by law. When information is no longer needed, we will delete, de-identify, or aggregate it according to our retention practices.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure. These safeguards may include encryption in transit, access controls, authentication protections, logging and monitoring, administrative access restrictions, security review procedures, backups, provider security review, and abuse prevention tools.

However, no method of transmission over the Internet and no method of electronic storage is completely secure. We cannot guarantee absolute security. You are responsible for protecting your password, keeping your email account secure, using secure devices, and notifying us if you believe your account has been accessed without authorization.

11. Your Privacy Choices

Depending on your location and applicable law, you may have the right to access personal information we hold about you, correct inaccurate information, delete certain personal information, export certain information, object to certain processing, restrict certain processing, withdraw consent where processing is based on consent, opt out of marketing communications, opt out of certain cookie-based advertising or tracking, and request information about how we collect, use, and disclose personal information.

You may update certain account information directly in your account settings. You may request access, correction, deletion, or export by contacting us at privacy@fieldworkaba.com or support@fieldworkaba.com. We may need to verify your identity before fulfilling a request. We may deny or limit requests where permitted by law, including when we must retain information for legal, security, fraud prevention, backup, accounting, or dispute-related reasons.

12. Account Deletion

You may request account deletion by contacting us or using available account tools. When your account is deleted, we will delete or de-identify personal information associated with your account unless we need to retain certain information for legal, security, fraud prevention, backup, accounting, dispute resolution, or other legitimate business purposes permitted by law. Deleting your account may remove access to fieldwork records, reports, forms, study history, supervisor connections, organization access, and other Service data. You should export important records before deleting your account.

13. Data Exports

FieldworkABA may allow you to export certain records, reports, forms, fieldwork data, or other information from your account. Available export formats may vary by feature, plan, and account status. You are responsible for reviewing exported information for accuracy and storing copies in a secure location.

14. Children’s Privacy

The Service is not intended for children under 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take reasonable steps to delete that information. If you believe a child has provided information to us, contact us at privacy@fieldworkaba.com.

15. International Users

FieldworkABA is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored in, or processed in the United States or other countries where we or our service providers operate. These countries may have privacy laws that differ from the laws in your location. By using the Service, you understand that your information may be processed in the United States and other jurisdictions as described in this Privacy Policy.

16. California and Other U.S. State Privacy Rights

Depending on your state of residence, you may have additional privacy rights under state privacy laws. These rights may include the right to know what categories of personal information we collect, the categories of sources, the purposes for collection, use, or disclosure, and the categories of third parties with whom we disclose information; access specific pieces of personal information; request correction of inaccurate personal information; request deletion of personal information; receive a copy of certain personal information in a portable format; opt out of certain sales, sharing, targeted advertising, or profiling where applicable; limit the use of sensitive personal information where applicable; appeal a denied privacy request where required by law; and not be discriminated against for exercising privacy rights.

If you use an authorized agent, we may require proof of authorization and may also verify your identity directly. We do not knowingly sell or share personal information of children under 18.

17. Notice to California Residents

If you are a California resident, California law may provide you with specific privacy rights. The categories of personal information we may collect include identifiers, such as name, email address, IP address, and account identifiers; customer records, such as billing and subscription information; commercial information, such as subscription history and payment status; internet or network activity, such as usage logs, device information, and feature interactions; education or certification-related information you choose to provide; professional or employment-related information you choose to provide; inferences, such as study patterns or product preferences; and sensitive personal information, if you choose to provide it or if it is necessary for account security.

We collect this information from you, your use of the Service, connected supervisors or organizations, and service providers. We use this information for the purposes described in this Privacy Policy, including providing the Service, securing accounts, processing payments, supporting users, improving features, and complying with legal obligations. We may disclose information to service providers, connected supervisors, connected trainees, organizations, payment processors, hosting providers, support providers, analytics providers, legal authorities where required, and parties involved in business transfers. 18. Canadian Users

If you are located in Canada, you may have rights under Canadian privacy laws, including the right to request access to personal information, request correction of inaccurate information, withdraw consent where applicable, and ask questions about our privacy practices. Your information may be transferred to, stored in, or processed in the United States or other jurisdictions. 19. European Economic Area, United Kingdom, and Similar Jurisdictions

If privacy laws in your location require a legal basis for processing, we may process personal information based on contractual necessity, such as providing the Service, managing accounts, processing payments, and responding to support requests; legitimate interests, such as improving the Service, securing accounts, preventing abuse, analyzing usage, and communicating with users; consent, such as where required for certain cookies, marketing communications, or optional features; and legal obligations, such as complying with tax, accounting, regulatory, or legal requirements.

We may use third-party service providers and subprocessors to provide and support the Service. These may include providers for cloud hosting, database storage, authentication, payment processing, email delivery, customer support, analytics, error tracking, security monitoring, file storage, document generation, AI-assisted or adaptive features, marketing communications, billing management, product performance monitoring, and administrative tools. We may update service providers from time to time as our business and technical needs change.

22. Business Transfers

If FieldworkABA is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, your information may be transferred as part of that transaction. 23. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we update it, we will revise the “Last Updated” date above. For material changes, we may provide additional notice by email, in-app notice, website notice, or another reasonable method. Your continued use of the Service after an updated Privacy Policy becomes effective means you accept the updated Privacy Policy. If you do not agree with the updated Privacy Policy, you should stop using the Service.

This Privacy Policy is governed by the laws of the United States, without regard to conflict-of-law principles.
